1. Agreement to Terms

By accessing or using HealthScriber ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

HealthScriber provides AI-powered medical documentation services including:

• Real-time medical transcription
• AI-generated summaries and letters
• Secure document storage and management
• Patient record management

3. User Responsibilities

You agree to:

• Provide accurate registration information
• Maintain the confidentiality of your account credentials
• Comply with all applicable laws and regulations
• Use the Service only for lawful medical documentation purposes
• Verify all AI-generated content before use

4. Medical Disclaimer

IMPORTANT: HealthScriber is a documentation tool only. It does not provide medical advice, diagnosis, or treatment. All AI-generated content must be reviewed and approved by a qualified healthcare professional before use. You remain solely responsible for all medical decisions and patient care.

5. Subscription and Payment

• Subscription fees are billed monthly in advance
• All fees are in Australian Dollars (AUD)
• Prices are subject to change with 30 days notice
• No refunds for partial months

6. Intellectual Property

You retain ownership of:

• Your medical records and patient data
• Content you create using the Service

We retain ownership of:

• The HealthScriber platform and technology
• AI models and algorithms
• Aggregated, anonymized usage data

7. Data Processing

By using the Service, you consent to:

• Processing of audio recordings for transcription
• AI analysis of medical content
• Storage of data in AWS Sydney (ap-southeast-2)
• Use of anonymized data for service improvement

8. Service Level Agreement

• 99.9% uptime target (excluding maintenance)
• Scheduled maintenance with 48 hours notice
• Best effort support response within 24 hours

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "as is" without warranties
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the fees paid in the last 12 months
• We are not responsible for medical decisions based on the Service

10. Indemnification

You agree to indemnify and hold harmless HealthScriber from any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Medical decisions or patient care

11. Termination

• Either party may terminate with 30 days written notice
• We may suspend or terminate immediately for Terms violations
• Upon termination, you may export your data for 60 days
• After 60 days, all data will be permanently deleted

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified 30 days in advance. Continued use after changes constitutes acceptance.
